Child Support
Basis for the Amount of Child Support: The laws governing child support have changed dramatically over the years. Pursuant to federal mandate a statewide child support guideline went into effect on March 1, 1991. This guideline is commonly called “Rule 1274”. The guideline considers the earnings of both parents, as well as the amount of time the child in question spends with each parent.
Child Custody and Visitation
Should child custody or visitation become a problem, the issue must first be submitted to Family Court Services or another mental health expert for mediation prior to court hearing. If the mediation fails, there are three ways of establishing in whose custody the best interest of the child will be served.
Adoption
At Hoffman & Hoffman, we assist our clients in obtaining a Step-Parent adoption. If a parent is not participating in your child’s life and your current spouse has the desire to adopt, then we can assist in that process for you. It is important to gain all of the facts and complete the process in a timely and appropriate manner. There are many pitfalls that can be encountered in the process and we at Hoffman & Hoffman work with our clients to avoid those. We do all we can to facilitate the ease and success of your adoption planning and process.
Premarital Agreement
Pursuant to Internal Revenue Code Section 1041, there is no gain or loss recognized on a transfer of property from an individual to a spouse or former spouse, if the transfer is “incident to the divorce.” This section applies throughout the marriage, as well as at divorce, and is unaffected by whether a non-divorce motive (or even a bona fide business purpose) is involved. It governs any transfer made after marriage even if pursuant to a premarital agreement.
Guardianship
Crystal received her Bachelor of Science in Criminal Justice with a minor in Sociology from California State University, Sacramento in 2014. After graduating, she worked for an adoption agency, where she gained interest in the guardianship process. She then attended University of the Pacific, McGeorge School of Law in Sacramento from 2016 to 2019. While at McGeorge, Crystal was a student member of the Anthony M. Kennedy Inn of Court and worked as a student attorney and interpreter in the Elder & Health Law Clinic and the Immigration Clinic. In 2019, University of the Pacific recognized Crystal as a Student Honoree for the Champion of Diversity & Inclusion award.
Spousal Support
The issue of permanent spousal support may arise in your case. It must be remembered that there are two components to the issue of permanent support. The first component is the amount of money, if any, to be paid by one spouse to the other. The second component is what we call the “reservation of jurisdiction” issue. Even if the court determines that no money should exchange hands between the spouses as and for spousal support, the issue still remains whether the court will keep the proverbial “foot in the door” and allow the supported spouse to come back and ask for spousal support in the future, upon a showing of a material and substantial change in circumstance.

Restraining Order
In many circumstances it is necessary for the court to make pendente lite (temporary) orders pending resolution of the entire proceeding. For example, a wife may be unemployed or have insufficient funds for the support of herself and the children. Thus, pendente lite child support and/or spousal support may be necessary. Furthermore, there may be a dispute as to the custody of the children or who will remain in the family residence. Pendente lite orders in this regard may be needed. It is not uncommon to request pendente lite attorney’s fees and costs as well as mutual restraining orders, restraining both parties from harassing and annoying each other and selling or disposing of any assets, except in the normal course of business or for the necessities of life.

There are many different types of corporations one can create when choosing this type of business formation. The primary difference between a corporation and a sole proprietorship is that a corporation is owned by the shareholders. A corporation can have a single shareholder or can have many shareholders.
